1. Introduction
These Terms and Conditions ("Agreement") govern the use of the Gulf Worker platform, a service designed to connect employers, recruitment agencies, and job seekers in the Gulf region. By accessing or using the Gulf Worker platform (the "Platform"), you agree to comply with and be bound by these Terms and Conditions. If you do not agree to these terms, you must not use the Platform.
2. Purpose of the Platform
Gulf Worker provides a platform where:
- Employers, companies, and recruitment agencies can create accounts to post job vacancies, and search for suitable candidates.
- Job seekers can create accounts to upload resumes, search for employment opportunities, and apply to job openings.
- Gulf Worker serves only as an intermediary between employers and job seekers and does not directly employ or offer jobs.
3. Account Creation and Registration
To use Gulf Worker's services, you may be required to create an account.
- For Job Seekers: You may register for free, create a profile, upload a resume, search for jobs, and apply to job listings.
- For Employers, Companies, and Recruitment Agencies: You must create an account to post job vacancies, search for candidates, and view contact details of job seekers.
You agree to provide accurate, current, and complete information during the registration process and maintain the confidentiality of your account credentials. You are responsible for all activities that occur under your account.
4. Services for Employers, Companies, and Recruitment Agencies
- Posting Jobs and Subscription Fee: Employers, companies, and recruitment agencies can post job vacancies on the Platform. The subscription fee for posting jobs and accessing candidates' contact information will be as outlined on the website.
- Free Job Posting: Gulf Worker offers a free job posting service for a limited time. After the free period expires, employers, companies, and recruitment agencies must pay the applicable subscription fee to continue posting jobs.
- Access to Candidate Information: Employers and recruitment agencies can access the resumes and contact information of job seekers who have consented to share their details with them.
5. Services for Job Seekers (Free of Charge)
Gulf Worker is a completely free platform for job seekers. Job seekers can:
- Create profiles and upload resumes
- Search for job listings and apply to job vacancies without any charge
- Gulf Worker does not charge job seekers any fees for posting resumes, applying for jobs, or accessing job opportunities
6. Consent to Share Contact Information
By submitting your resume or profile to Gulf Worker, you grant Gulf Worker permission to share your contact details, including but not limited to email addresses and phone numbers, with employers, recruitment agencies, or other authorized users who may be interested in contacting you about job opportunities.
7. No Warranty or Guarantee
Gulf Worker makes no warranty, express or implied, regarding the accuracy, completeness, or timeliness of any information provided by users on the Platform. Specifically:
- Gulf Worker does not guarantee that job postings will result in employment or hiring
- Gulf Worker does not guarantee any outcomes related to job applications or recruitment processes
- Gulf Worker does not make any representation or warranty regarding the success or failure of any job opportunity listed on the Platform
8. Subscription Fees and Refund Policy
- Subscription Fees: Employers, companies, and recruitment agencies are required to pay subscription fees to post job vacancies and access candidates' contact details.
- Non-Refundable: All subscription fees paid are non-refundable once processed, even if the user chooses not to use the services after payment.
- No Charges for Job Seekers: Job seekers will not be charged any fees for using the services of Gulf Worker.
9. Acceptable Use of the Platform
You agree to use Gulf Worker for lawful purposes only. You will not:
- Post any content that is illegal, misleading, fraudulent, or discriminatory
- Post content that infringes on any intellectual property rights or violates any applicable laws
- Engage in any activity that may harm or exploit others, including minors
- Transmit any harmful software or viruses
10. Content Removal and Account Suspension
Gulf Worker reserves the right to remove any content or suspend accounts if:
- The content violates these Terms and Conditions or Gulf Worker's policies
- The content has been reported by users or deemed inappropriate
- Such action is necessary to protect the Platform or its users
- Repeated complaints are received about the same job posting
11. Privacy and Data Protection
By submitting personal information to Gulf Worker, you acknowledge that your data will be handled according to our Privacy Policy. Gulf Worker is committed to protecting your privacy and will not share your personal information with third parties except when required to facilitate job seeking or hiring processes.
12. Limitation of Liability
Gulf Worker shall not be liable for any damages, losses, or claims arising from:
- The accuracy or completeness of any information posted on the Platform
- Actions taken by users as a result of interactions on the Platform
- Any disputes between employers and candidates
- The success or failure of any job search or hiring process
13. Governing Law and Dispute Resolution
This Agreement shall be governed by and construed in accordance with the laws of Navi Mumbai, India. Any dispute arising out of or relating to the use of the Gulf Worker platform shall be subject to the exclusive jurisdiction of the courts located in Navi Mumbai, India.
